These Terms of Service (the "Terms") govern your access to and use of the TravelM8 website, planner, AI Trip Concierge, mobile companion (PWA), and any related services (together, the "Service") operated by the sole proprietor trading as TravelM8, registered in the Netherlands (the "Operator", "we", "us", or "our"). By accessing or using the Service you (the "User" or "you") agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Definitions
- "Account" means the user record created when you sign up using a magic-link email.
- "Free Tier" means the no-cost level of access described in Section 6.
- "Premium" means the paid subscription level of access described in Section 7.
- "Subscription" means a recurring paid agreement to receive Premium for a specified Billing Period (monthly or yearly).
- "Billing Period" means the interval (one month or one year) at which Premium auto- renews until cancelled.
- "Estimate" means a non-binding editorial cost projection produced by the Service, as further described in Section 14.
- "Partner" means a third-party provider (e.g., Booking.com, Skyscanner, GetYourGuide, World Nomads, Airalo, Welcome Pickups, iVisa, Wise, NS) to which the Service may link or refer.
2. The Service
TravelM8 is a travel planning tool. We produce cost estimates, visa information, and curated booking links for trips you plan with us. We are not a booking platform: we do not sell flights, hotels, insurance, visas, or activities. Bookings happen with Partners under those Partners' own terms (see Section 15).
Premium adds the AI Trip Concierge with web search, partner deep-link tools, and other features. Some Premium features are described as forthcoming on the marketing pages and ship over time; access to forthcoming features is included in your Subscription as they become available.
3. Acceptance and Capacity
You confirm that you are at least 18 years of age (or the age of majority in your jurisdiction) and have full legal capacity to enter into these Terms. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation, in which case "you" refers to both you and the organisation.
4. Account
You may use much of the Service without an Account. Saving a trip, taking out a Subscription, and using the Concierge all require you to sign in. We authenticate you via single-use magic links sent to your email address (validity: 15 minutes); we never store passwords.
You are responsible for the security of the email address you use to sign in. Do not forward or share magic-link emails — they grant full access to your Account. Notify us promptly at hello@thetravelm8.com if you suspect unauthorized access.
You can delete your Account at any time from /profile. Deletion is described in our Privacy Policy.
Service emails. When you save a trip we send you a small set of automated emails: a visa preparation nudge ~90 days before the start date (only when the destination requires a visa for your passport), a packing/checklist reminder ~3 days before, a feedback survey ~3 days after the end date, and a retrospective with destination suggestions ~30 days after. Each email contains a one-click unsubscribe link that disables future marketing/lifecycle emails immediately. Sign-in magic links and billing receipts continue to send regardless of that preference, since they are operational communications without which the Service cannot function.
5. Acceptable Use
You agree not to:
- access or attempt to access another User's data;
- scrape, mirror, frame, or systematically extract data from the Service beyond what we expose publicly through normal browsing;
- circumvent rate limits, free-tier quotas, or other technical restrictions;
- submit false or misleading information to evade limits or obtain Service benefits to which you are not entitled;
- use the Service to facilitate violations of applicable sanctions, export controls, or travel restrictions;
- upload or submit content that is unlawful, infringing, defamatory, harmful, or harassing; or
- attempt to interfere with the security, integrity, or availability of the Service.
We may suspend or terminate Accounts that violate this Section, immediately and without refund where the breach is material.
6. Free Tier
The Free Tier is offered at no charge. It includes unlimited trip planning and previews, the full single-screen dashboard, source-cited estimates, the offline checklist, and the spend log. It permits saving up to three (3) trips per Account on a lifetime basis; the cap is enforced server-side and resets only on Account deletion. The Free Tier also includes limited use of the AI Trip Concierge (Claude Haiku 4.5, three messages per rolling 30-day window per Account).
7. Premium Subscription
Premium is a paid subscription priced at €11.99 per month or €119.00 per year, both inclusive of any applicable VAT (see Section 8). Premium unlocks unlimited saved trips, the AI Trip Concierge on Claude Opus 4.7 with partner deep-link tools (twenty messages per rolling 24-hour window), the offline PWA companion, and forthcoming Premium features.
Your Subscription begins on the date the first payment is successfully captured by our payment processor (the "Activation Date") and renews automatically at the end of each Billing Period at the then-current price for the same Billing Period unless and until cancelled in accordance with Section 11.
8. Pricing, VAT and Payment
All prices are stated in Euros (EUR) and are inclusive of any value-added tax (VAT) where applicable. The Operator currently operates under the Dutch small-business scheme (Kleineondernemersregeling, "KOR") and therefore does not charge VAT on Subscriptions while it remains within the scheme's thresholds. If the Operator ceases to qualify for the scheme, prices remain the same total amount but VAT will be itemised separately on invoices going forward.
Payments are processed by Stripe Payments Europe, Limited ("Stripe"), our payment processor. We do not receive or store your full card details; Stripe processes your payment under its own terms. By providing payment information, you authorize Stripe and us to charge the applicable amount to your selected payment method on the Activation Date and on each subsequent renewal date.
We may change Subscription prices for future Billing Periods. We will notify you at least thirty (30) days before a price change takes effect. If you do not agree, you may cancel before the change takes effect; your existing paid period will be honored at the original price.
If a renewal payment fails, our payment processor will retry according to its standard schedule. If the payment ultimately cannot be collected, your Subscription will be suspended and Premium access will revert to the Free Tier limits until payment is resolved.
9. Right of Withdrawal — Express Consent and Acknowledgement
Under Article 6:230o of the Dutch Civil Code (implementing Article 16(m) of Directive 2011/83/EU on consumer rights), consumers are normally entitled to withdraw from a distance contract for digital services within fourteen (14) days of the contract's conclusion, without giving reasons.
Because the Service is a digital service that is delivered immediately upon Activation, your right of withdrawal expires once performance has begun, provided that you give your prior express consent and acknowledge that you will lose the right of withdrawal once the contract is fully performed.
By selecting a Subscription, accepting these Terms (e.g., by ticking the "I agree to the Terms of Service" checkbox at Checkout), and submitting payment, you expressly consent to immediate performance of the Service and acknowledge that you thereby lose your right of withdrawal under Article 6:230o BW. If you do not wish to waive your right of withdrawal, do not initiate the Subscription.
The above does not affect any non-waivable statutory rights you have as a consumer under mandatory provisions of Dutch or EU law.
10. Refund Policy
Subject to Section 9, Subscription fees are non-refundable once the Billing Period has begun. We do not refund partial periods, unused features, or pro-rata amounts upon cancellation, except in the limited cases set out below.
We will issue a pro-rata refund of the affected Billing Period if (a) we materially fail to provide the Service for fifteen (15) or more consecutive days within that period as a result of issues attributable to us (excluding events of force majeure under Section 24), or (b) we are required to do so under mandatory consumer-protection law.
Refund requests must be sent to hello@thetravelm8.com with your Account email and a description of the issue. We will respond within fourteen (14) days. Approved refunds are credited to the original payment method.
11. Cancellation by You
You may cancel your Subscription at any time from your Profile or via the Stripe Customer Portal accessible from your Account. Cancellation takes effect at the end of the current Billing Period: you retain Premium access until that date, and no further charge will be made unless you re-subscribe.
Cancellation does not entitle you to a refund of fees already paid for the current Billing Period (see Section 10).
12. Suspension and Termination by Us
We may suspend or terminate your Account or Subscription with or without notice if (a) you breach these Terms in a material way, including Section 5; (b) we are required to do so by law, regulation, or court order; (c) your use poses a security or legal risk to us or other Users; or (d) we discontinue the Service in whole or in part (in which case Section 23 applies).
On termination by us for material breach, no refund is due. On termination by us for our convenience, we will refund a pro-rata portion of the unused part of the current Billing Period.
13. User Content
The Service does not host substantial user-generated content. Where you submit text (e.g., Concierge prompts, custom trip notes, support emails), you grant us a worldwide, royalty-free, non-exclusive licence to use it solely to operate, maintain, and improve the Service.
We do not use your trip content or Concierge prompts to train third-party AI models. AI providers we engage (e.g., Anthropic) are bound by their own data-protection commit- ments; see our Privacy Policy for details.
14. Estimates — Editorial Nature, Accuracy, No Warranty
All cost figures shown by the Service are Estimates, not live quotes or binding prices. Estimates are produced from a combination of editorially-curated rules, public Partner data, official tourism-board and government sources, and historical pricing ranges. Real prices at booking time can and do vary. Methodology is published at /estimates.
Visa, immigration, and travel-advisory data are sourced from the destination country's official authority and our internal rules table. Each visa row links to the official source. Rules change with little notice; you must verify with the official source before travel and before relying on any Estimate. We do not provide legal, immigration, tax, or financial advice.
We do not warrant that Estimates will match actual booking prices, that visa rules will not change between display and travel, that Partner availability or pricing will remain stable, or that the Service will be free of errors or interruptions.
15. Third-Party Bookings and Affiliate Relationships
When you click a booking link (e.g., "Book on Booking.com") you leave the Service and complete the booking with the Partner under the Partner's own terms. We are not a party to that transaction. Refunds, cancellations, complaints, and disputes relating to that booking must be raised with the Partner.
We may receive affiliate commissions from some Partners when you complete a qualifying transaction after following a link from the Service. Commissions never change what we recommend; see /how-we-earn for the full disclosure.
16. Intellectual Property
The Service, including its text, graphics, logos, code, underlying datasets, and overall "look and feel," is owned by the Operator or its licensors and is protected by copyright, trademark, and other intellectual-property laws. We grant you a limited, non-exclusive, non- transferable, revocable licence to use the Service for your personal, non-commercial trip-planning purposes, in accordance with these Terms.
The TravelM8 name, logo, and trade dress are our trademarks. You may not use them without our prior written consent except for fair-use editorial reference.
17. Privacy and Data Protection
Our processing of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference. We act as the data controller for personal data processed in connection with the Service, except where you direct us otherwise.
18. Disclaimers
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.
19. Limitation of Liability
To the maximum extent permitted by law, in no event will the Operator be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, opportunity, or goodwill, arising out of or in connection with the Service or these Terms, even if advised of the possibility of such damages.
Our aggregate liability arising out of or in connection with the Service or these Terms is limited to the amount you have actually paid us in the twelve (12) months preceding the event giving rise to the claim, or, if you have paid us nothing in that period, to fifty euros (€50.00).
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable mandatory law (including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation).
20. Indemnification
You agree to indemnify and hold harmless the Operator against any third-party claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of (a) your breach of these Terms, (b) your misuse of the Service, or (c) your violation of any law or third-party right.
21. Modifications to These Terms
We may update these Terms from time to time. The "Version" identifier at the top of this page reflects the current version. Material changes — such as changes to pricing, billing, refund rules, or governing law — will be communicated to signed-in Users by email or in-product notice at least thirty (30) days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
For new Subscriptions, the Terms in force at Checkout govern the Subscription, and acceptance of those Terms is recorded with a version stamp on your Account.
22. Modifications to the Service
We may add, change, or remove features at any time. Where a change materially reduces the value of an active paid Subscription, we will either provide a comparable replacement, refund a pro-rata portion of the unused part of the current Billing Period, or both, at our discretion.
23. Governing Law
These Terms and any non-contractual obligations arising in connection with them are governed by the laws of the Netherlands, without regard to conflict- of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
If you are a consumer, you also benefit from the mandatory provisions of the consumer-protection law of the country in which you reside.
24. Dispute Resolution and Jurisdiction
Any dispute arising out of or in connection with these Terms or the Service that cannot be resolved amicably will be submitted to the exclusive jurisdiction of the competent courts of Amsterdam, the Netherlands, save where mandatory consumer-protection rules confer jurisdiction on the courts of your country of residence.
The European Commission also operates an Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
25. Force Majeure
Neither party will be liable for any failure or delay in performance to the extent caused by circumstances beyond its reasonable control, including acts of God, war, terrorism, civil unrest, government action, internet or telecommunications failure, third-party service-provider outage, fire, flood, earthquake, or pandemic.
26. General
These Terms (together with the documents they reference) constitute the entire agreement between you and the Operator concerning the Service and supersede any prior agreements on the same subject. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable. Our failure to enforce any right or provision is not a waiver. You may not assign or transfer these Terms without our prior written consent; we may assign these Terms to a successor in connection with a merger, acquisition, or sale of substantially all of our assets.
